The General Terms and Conditions (hereinafter ‘AGB’) of natelo AG (hereinafter, unless specified otherwise, ‘natelo’) apply to all products specified by natelo AG in shops, the online shop, or in written offers, as well as all purchase agreements and deliveries by natelo to its customers.
A customer is defined as any natural or legal person who maintains a business relationship with natelo.
A valid contract in the online shop requires that the customer’s place of residence or business is in Switzerland or Liechtenstein. If the customer is a consumer, they must reside in Switzerland and affirm this.
Natelo provides all deliveries and services for orders placed in the online shop exclusively based on these AGB, in the version valid at the time of the order. By purchasing or placing an order, the customer acknowledges the AGB.
Written individual agreements that deviate from these AGB between natelo and the customer remain reserved.
Clauses
The product and service information published online or in written offers by natelo is considered a non-binding offer. All details are subject to potential price inaccuracies (on the part of manufacturers or natelo) or delivery impossibilities and can be modified by natelo at any time.
The offers in the online shop or in written offers by natelo are merely an invitation to submit an offer. The customer's order is binding for the customer. The customer is responsible for the online order, and the order is processed by natelo as it is received, without further confirmation from the customer. Natelo is free to decline the processing of an order at any time without providing reasons. Generally, orders for more than three hardware devices are not allowed for private customers; in such cases, natelo will inform the customer. A purchase contract is only concluded when and if natelo fulfills the customer's order. If the customer concludes a mobile, internet, TV, or landline contract with natelo, they accept the respective partner’s AGB, which can be viewed here:

The information online or in written offers by natelo (such as images, dimensions, technical specifications, or other services) is to be understood only as a guideline and does not constitute a warranty of characteristics in the sense of Article 197 of the Swiss Code of Obligations. This information is provided by manufacturers and suppliers and is adopted as is. Therefore, no liability can be assumed for the accuracy, completeness, or timeliness of the information.
The prices indicated on the receipt and in the order confirmation sent by email or mail are decisive. If these prices are higher than those at the time of the order, the latter will apply. In case of delivery delays, the daily price on the order date applies.
Unless otherwise agreed, the prices are in Swiss Francs and include VAT, advanced recycling fees, and any applicable copyright fees.
Any price changes are reserved at all times.
The payment options listed in the online shop are available as means of payment.
The payment deadlines stated on the invoice begin on the invoice date. If the customer does not pay the invoice amount within this period, they will be in default without further reminder.
- Payment reminder: free of charge
- 1st Reminder: CHF 25 plus default interest
- 2nd Reminder: CHF 25 plus default interest
- Debt collection transfer: CHF 20
The following payment terms apply to business customers:
- Payment is only possible by invoice. However, natelo reserves the right to deliver only against advance payment.
- The invoice amount is considered accepted unless the customer objects within 7 days.
- The devices remain the property of natelo until full payment has been made.
- The invoice is due within 10 days. In case of late payment, the customer owes the statutory default interest without further reminder and is also responsible for all collection costs incurred by natelo.
Dates and delivery times are generally non-binding. The indication of specific delivery times and dates by natelo is subject to correct and timely delivery by suppliers and manufacturers. Delivery dates may also be changed at any time by suppliers or manufacturers after the order is received.
The delivery of an order confirmation does not constitute a guarantee that the product is actually in stock or can be delivered. Any liability on the part of natelo is excluded. If delivery does not occur, the customer has the right to withdraw from the contract 30 days after the stated delivery date.
Risk is transferred to the customer upon shipment of the product.
The customer is obligated to accept the services or products delivered by natelo.
If the customer refuses to accept or declares unwillingness to accept the goods, the resulting costs may be charged to the customer in the form of a handling fee. If the customer refuses to accept an order, a flat fee of CHF 60 plus incurred shipping costs will be charged. For orders with a subscription from a mobile provider, a flat fee of CHF 100 plus incurred shipping costs will be charged.
Amounts transferred via credit card, Postcard, Post E-Finance, or Twint will be credited back to the original account, minus the handling fee of CHF 60 or CHF 100, respectively.
Transport damages and incorrect deliveries must be reported within 48 hours of receiving the shipment to [email protected]. In such cases, the device must not be used under any circumstances.
natelo or the supplier/manufacturer provides a warranty for the defect-free condition and functionality of the products sold by natelo. natelo offers a warranty for the following duration:
- 24 months for mobile phones, tablets, smartwatches, and other devices, as well as all accessory products (except Apple; see below);
- 12 months on all Apple products;
- 12 months for used mobile phones and other devices, as well as factory-sealed mobile phones from the natelo refreshed range.
- 6 months on wear parts such as batteries and rechargeable batteries (built-in / included);
- 3 months on repairs (replaced parts and labor), as well as on replacement devices (swaps).
The warranty period begins at the time of delivery or collection of each product. The warranty duration is not interrupted by any warranty claim but continues to run. The delivery note/receipt serves as the warranty certificate and should be kept carefully.
Excluded from the warranty are:
- Damage caused by natural elements;
- Moisture damage;
- Impact or drop damage or any other damage caused by external forces;
- Natural wear and tear;
- Software issues;
- Incorrect handling;
- Tampering with or modifications to the product;
- Consumables, casing parts, and similar items.
The replacement of parts, assemblies, or entire devices does not initiate new warranty periods. Warranty claims against natelo are only available to the direct customer and are not transferable.
In the event of a warranty claim, there is a right to repair, replacement, or contract rescission. The choice of how to remedy the defect lies with natelo. If natelo decides to rescind the contract, a credit will be issued at the current daily price (up to the maximum sale price at the time of the order).
If it is determined that a returned or submitted product is not covered by the warranty (due to exclusion reasons or being outside the warranty period), a cost estimate for the expected repair costs will automatically be prepared. If the customer declines the repair, a handling fee may be charged to the customer.
For device purchases with a network provider installment plan, only the general terms and conditions of the respective network provider apply.
The statutory warranty is fully excluded.
Customers who dispose of their mobile phones through natelo or use the natelo buy-back program agree that by returning their device, they waive all ownership rights to it. natelo assumes no responsibility for the loss of customer data on devices returned as part of the buy-back program. Before returning the device, the following steps must be taken:
Delete data on hard drives and other storage devices in the products.
Create a backup copy before deleting data or transferring the data to another storage medium.
Remove all removable media such as PCMCIA or SIM card.
Once the device has been returned to natelo, natelo can no longer return it to the customer. By participating in either of the mentioned programs (buy-back/disposal), the customer waives all rights to the device and any other associated materials handed over to natelo.
natelo provides this service voluntarily and assumes no liability for the services performed in connection with the return programs mentioned here. In particular, natelo disclaims liability for lost profits, business losses, or other consequential damages, as well as for direct or indirect damages.
Devices returned through the natelo buy-back program and the components contained in these products are reused, recycled, or disposed of in accordance with the regulations applicable in the European Union and Switzerland.
Introduction
deinabo is an online shop by natelo.
Returns
Returns of products are made at the customer’s expense and risk to the return address specified by deinabo. The customer must always notify the return in advance in writing.
Returns and Exchanges
deinabo products purchased in this online shop or in a natelo shop are not eligible for returns. For all subscriptions the customer enters into here, the respective general terms and conditions of the network providers apply. This may include penalty fees as defined by the respective network provider. deinabo.ch is solely a mediation platform for the services of the respective network providers.
natelo websites may contain links to third-party websites. Third-party websites may also link to natelo websites. natelo assumes no responsibility for such websites, their content, the products, services, or other offerings provided, nor for their compliance with data protection regulations, and expressly distances itself from them. Activating a link is at the user’s own risk.
The personal customer data collected as part of contract processing is stored by natelo and may be used for both contract processing and marketing and statistical purposes. In all these cases, the data may also be disclosed to and used by companies associated with natelo. natelo is authorized to use the personal customer data collected during contract processing for marketing communication with the customer (e.g., via SMS/MMS, email, or post). The customer can inform natelo and deinabo at any time at [email protected] if they no longer wish to receive marketing communications.
Customer payments in the natelo online shop are made in a secure area (Saferpay), where the data is transmitted encrypted. natelo assumes no responsibility for the security of the transmission and the transmitted data.
All image material used by natelo is protected by copyright and may only be used with natelo's consent. Detailed provisions and explanations are provided in natelo's privacy policy.
The legal relationship between the customer and natelo is governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods.
The courts competent for the Canton of Zug have exclusive jurisdiction over all disputes arising from or in connection with this legal relationship. Mandatory jurisdictions, particularly consumer courts, are reserved.
If any provision of these AGB is or becomes invalid, the remaining provisions of these AGB shall not be affected. natelo and the customer hereby agree to establish a regulation that corresponds as closely as possible to the intent and purpose of the invalid provision.
Changes, additions, and side agreements to these AGB must be in writing.
These AGB come into effect on July 9, 2024.
