The General Terms and Conditions (hereinafter ‘GTC’) of natelo AG (hereinafter, unless otherwise specified, ‘natelo’) apply to all products specified by natelo AG in shops, in the online shop or in written offers, as well as to all purchase agreements and deliveries made by natelo to its customers.
A customer is defined as any natural or legal person who maintains a business relationship with natelo.
A prerequisite for a valid contract conclusion in the online shop is that the customer’s residence or registered office is located in Switzerland or Liechtenstein. If the customer is a consumer, they must reside in Switzerland and confirm this.
natelo provides all deliveries and services for orders placed in the online shop exclusively on the basis of these GTC, in the version valid at the time of the order. By purchasing or placing an order, the customer acknowledges the GTC.
Written individual agreements between natelo and the customer that deviate from these GTC remain reserved.

Clauses

1- Order and contract conclusion

The product and service information published online or in written offers by natelo is considered a non-binding offer. The details are always subject to incorrect price information (by the manufacturers or by natelo) or delivery impossibility and may be changed by natelo at any time.

The offers in the online shop or in written offers from natelo are merely an invitation to submit an offer. The customer’s order is binding for them. The customer is responsible for the online order, and the order will be processed by natelo exactly as it is received, without further inquiry. natelo is free to decline the processing of an order at any time without providing reasons. As a general rule, orders exceeding three hardware devices are not possible for private customers. In such cases, natelo informs the customer. A purchase contract is only concluded if and when natelo executes the customer’s order. If the customer concludes a mobile, internet, TV or landline contract with natelo, they accept the respective partner’s GTC, which can be viewed here:

The information provided online or in written offers from natelo (images, dimensions, technical specifications or other services) is to be understood only as a guideline and does not constitute a guarantee of characteristics within the meaning of Art. 197 of the Swiss Code of Obligations. This information is provided and supplied by manufacturers and suppliers. Therefore, no liability can be assumed for the accuracy, completeness or timeliness of the information.

2- Prices

The prices stated on the receipt as well as in the order confirmation sent by e-mail or letter are decisive. If these prices exceed those valid at the time of the order, the latter shall apply. In the event of delivery delays, the daily price on the order day applies.

Unless otherwise agreed, prices are in Swiss francs and include value-added tax, advance recycling fees and any copyright-related charges.

Any price changes are subject to change at any time.

3- Payment processing

The payment options listed as available in the online shop may be used.

The payment deadlines stated on the invoice begin on the invoice date. If the customer does not pay the invoice amount within this period, they will be in default without further reminder.

  • Payment reminder: free of charge
  • 1st reminder: CHF 25.– plus default interest
  • 2nd reminder: CHF 25.– plus default interest
  • Transfer to debt collection: CHF 20.–

The following payment terms apply to business customers:

  • Payment is only possible by invoice. However, natelo reserves the right to deliver only against prepayment.
  • The invoice amount is considered accepted unless the customer objects within 7 days.
  • The devices remain the property of natelo until full payment has been made.
  • The invoice is due within 10 days. In the event of late payment, the customer owes the statutory default interest without further reminder and must also cover all debt collection costs of natelo.
4- Delivery and service time

Delivery dates and deadlines are generally non-binding. The indication of specific delivery times and dates by natelo is subject to correct and timely delivery by suppliers and manufacturers. Delivery dates may be changed at any time by suppliers or manufacturers even after receipt of the order.

The submission of an order confirmation does not constitute a promise that the product is actually in stock or can be delivered. Any liability on the part of natelo is excluded. If delivery does not occur, the customer has the right to withdraw from the contract 30 days after the stated delivery date.

Risk transfers to the customer when the product is dispatched.

5- Obligation to accept, cancellation

The customer is obliged to accept the services or products delivered by natelo.

If the customer refuses acceptance or declares that they do not wish to accept the goods, the costs incurred may be charged to the customer in the form of a handling fee. If the customer refuses to accept an order, a flat fee of CHF 60.– plus incurred shipping costs will be charged. For orders that include a subscription with a mobile provider, a flat fee of CHF 100.– plus incurred shipping costs will be charged.

Amounts paid by credit card, Postcard, Post E-Finance or Twint will be credited back to the original account minus the handling fee of CHF 60.– or CHF 100.– respectively.

6- Delivery defects

Transport damage and incorrect deliveries must be reported within 48 hours of receiving the shipment to logistics@natelo.ch. In such cases, the device must not be used under any circumstances.

7- Warranty provisions

natelo or the supplier/manufacturer provides a warranty for the freedom from defects and the functionality of the products sold by natelo. natelo grants a warranty for the following periods:

  • 24 months for mobile phones, tablets and smartwatches and other devices, as well as all accessory products (exception Apple; see below);
  • 12 months on all Apple products;
  • 12 months for used mobile phones and other devices, as well as originally packaged mobile phones from the natelo refreshed range.
  • 6 months on wear parts such as batteries and rechargeable batteries (built-in / included);
  • 3 months on repairs (replaced parts and labor), as well as on replacement devices (swap).

The warranty period begins at the time of delivery or collection of each product. The warranty period is not interrupted by a warranty claim and continues to run. The delivery note / receipt serves as the warranty certificate and must be kept carefully.

The following are excluded from the warranty:

  • damage caused by natural events;
  • moisture damage;
  • impact or drop damage or other damage caused by external influences;
  • normal wear and tear;
  • software issues;
  • incorrect handling;
  • interventions or modifications to the product;
  • consumables, housing parts and similar.

The replacement of parts, assemblies or entire devices does not result in a new warranty period. Warranty claims against natelo are available only to the direct customer and are non-transferable.

If a warranty case occurs, the customer is entitled to repair, replacement or rescission. The choice of how to remedy the defect lies with natelo. If natelo decides to rescind the contract, a credit will be issued at the daily price (up to the maximum of the sales price at the time of the order).

If it is determined that a submitted/sent-in product is not covered by the warranty (exclusion reasons or outside the warranty period), a cost estimate for the expected repair costs will automatically be prepared. If the customer declines the repair, a handling fee may be charged.

For device purchases with an installment plan from a network provider, exclusively the GTC of the respective network provider apply.

The statutory warranty is fully excluded.

8- Right of return

natelo offers a limited right of return. For certain items, a right of return exists if the return conditions are met. A return is only possible within 14 calendar days after receipt of the goods; the relevant date is the date of delivery or collection in the shop (the period begins on the day the goods are received/collected in the shop). There is no right of return for service contracts such as subscriptions from network providers.

Opened packaging, removed seals, visible signs of use or devices that have already been put into operation are excluded from the right of return. In such cases, natelo may refuse the return or deduct a reasonable depreciation from the refund amount.

The return shipment is at the customer’s expense unless it is a technical defect covered by the warranty. Returns without prior notification will not be accepted.

After receipt and inspection of the goods, the purchase price will be refunded to the original payment method, provided the goods are in perfect condition. A refund is only issued after successful quality control.

9- Provisions for buyback program and disposal

Customers who dispose of their mobile phones through natelo or use natelo’s buyback program agree that by returning their device, they waive all ownership rights to it. natelo assumes no responsibility for the loss of customer data on devices submitted as part of the buyback program. Before returning the device, the following steps must be taken:

Deleting data on the hard drives and other storage devices in the products

Creating a backup before deleting data or transferring the data to another storage medium.

Removing all removable media such as PCMCIA or SIM cards

Once the device has been returned to natelo, it can no longer be returned to the customer. By participating in either of the two programs (buyback / disposal), the customer waives all rights to the device and all other associated materials submitted to natelo.

natelo provides this service voluntarily and assumes no liability for the services performed in connection with the return programs mentioned here. natelo expressly rejects any liability for lost profits, business losses or other consequential damages as well as direct or indirect damages.

Devices returned to natelo as part of the buyback program and the components contained in these products are reused, recycled or disposed of in accordance with the regulations applicable in the European Union and Switzerland.

10- Provisions for Powerology screen protection

natelo is not liable for any damage to devices after the application and installation of a Powerology protective film.

11- Additional provisions for products of the brand deinabo.ch

Introduction

deinabo is an online shop operated by natelo.

Returns

Returns of products are made at the customer’s expense and risk to the return address specified by deinabo. A return must always be announced in writing by the customer.

Returns and exchanges

deinabo products purchased in this online shop or in a natelo shop are not eligible for return. For all subscriptions concluded by the customer here, the respective GTC of the network providers apply. Penalty fees may apply, which are defined by the respective network provider. deinabo.ch is solely a mediation platform for the services of the respective network providers.

13- Provision workshop report

The assessment of a workshop report is subject to the respective insurance company. natelo is not liable for any payout and serves solely to evaluate the damage based on our guidelines.

14- Disclaimer of liability

natelo’s liability is hereby excluded to the extent permitted by law.

15- Disclaimer for external links

natelo websites may contain links to third-party websites. Third-party websites may also link to natelo websites. natelo assumes no responsibility for such websites and their content, for the products, services or other offers they provide, or for compliance with data protection regulations, and distances itself from them. Activating a link is done at the user’s own risk.

16- Security and data protection

The personal customer data collected as part of contract processing is stored by natelo and may be used, on the one hand, for contract processing and, on the other hand, for marketing and statistical purposes. In all these cases, the data may also be disclosed to companies affiliated with natelo and used by them accordingly. natelo is entitled to use the personal customer data collected during contract processing for marketing communication with the customer (e.g. via SMS/MMS, email or post). The customer may inform natelo or deinabo at hello@natelo.ch at any time that they no longer wish to receive marketing communication.

Customer payments in the natelo online shop are made in a secure area (Saferpay), where the data is transmitted in encrypted form. natelo assumes no liability for the security of the transmission or the transmitted data.

All image material used by natelo is protected by copyright and may only be used with the consent of natelo. Detailed provisions and explanations can be found in natelo’s privacy policy.

17- Applicable law and place of jurisdiction

The legal relationship between the customer and natelo is governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods.

The courts responsible for the Canton of Zug have exclusive jurisdiction over all disputes arising from or in connection with this legal relationship. Mandatory jurisdictions, particularly consumer jurisdictions, remain reserved.

18- Final provision

If a provision of these GTC is or becomes invalid, the remaining provisions of these GTC shall not be affected. natelo and the customer hereby agree to establish a regulation that corresponds as closely as possible to the meaning and purpose of the invalid provision.

Changes, additions and ancillary agreements to these GTC must be made in writing.

19- Entry into force

These GTC enter into force on 09 July 2024.

To make a return via post or a drop-off point, request a return label through your account on our website. Shipping costs are to be covered by the customer, except for defective products.

Defective or damaged product

If you have received a defective or damaged product, please contact our customer service. In such cases, we will send you a replacement product or refund the purchase price.

If a refund was issued by mistake or the amount is incorrect, please contact our customer service immediately to resolve the issue.
